CTP insurance covers personal injury, not damage to your vehicle. Statutory benefits and a claim for damages have different eligibility rules. Your accident date, injuries and circumstances affect the options available to you.
Book a free consultation with Stephen Young Lawyers for clear advice on your next steps. Bring any claim number, insurer letters and medical information you have. We act on a No Win No Fee basis for eligible claims; we will explain the costs arrangements before you decide to proceed.
For related information, see our road accident compensation guide and hit-and-run claims guide. If injury has stopped you working, ask whether a separate TPD insurance claim may be relevant; the policy has its own requirements.
A CTP claim is a personal injury compensation claim made against the insurer of the vehicle involved in a motor accident.
In NSW, CTP insurance, also known as a Green Slip, covers compensation for injuries sustained in road accidents. It does not cover damage to vehicles or property.
CTP claims may apply to drivers, passengers, motorcyclists, cyclists and pedestrians injured in a motor accident. Depending on the circumstances, the claim is generally made against the insurer of the at-fault vehicle.
Because the scheme involves detailed legal and medical assessments, it is important to understand how the process works and what entitlements may be available.
CTP claims in NSW operate under a statutory scheme for people injured in motor accidents. The accident date determines which scheme and rules apply.
Statutory benefits may include treatment and care expenses and weekly income payments, subject to eligibility, time limits and exclusions. Some benefits may be available even if you were at fault.
A damages claim has separate requirements. For accidents covered by the Motor Accident Injuries Act 2017, another person’s fault and an injury that is not a threshold injury are generally required. Being free of fault alone does not establish entitlement. Economic loss and non-economic loss have different requirements; compensation for pain and suffering requires permanent impairment greater than 10%.
We can assess your accident circumstances, injury classification and evidence, and explain which benefits or damages may be available.
The compensation available under a CTP claim will depend on the nature of your injuries and the impact they have on your life.
In general, a CTP compensation claim in NSW may include medical and treatment expenses, rehabilitation costs and loss of income. Where injuries result in long term limitations, claims may also consider future economic loss and the need for ongoing care.
In more serious cases, compensation for pain and suffering may be available, subject to the legal thresholds that apply.
Each claim is assessed on its own facts, and the outcome will depend on both medical evidence and the circumstances of the accident.
For accidents covered by the current NSW CTP scheme, a claim for personal injury benefits should generally be lodged within three months of the accident. Lodging within 28 days is important for weekly payments to be backdated to the day after the accident; it is not the general deadline for every type of CTP compensation.
If you have missed a deadline, seek advice promptly. Exceptions may apply, and the rules differ depending on the accident date and the type of claim. A claim for damages has separate requirements and time limits.

Under the NSW CTP scheme, certain injuries are classified as threshold injuries, previously referred to as minor injuries.
These typically include soft tissue injuries such as whiplash and some psychological conditions. If an injury is assessed as a threshold injury, statutory benefits are generally limited to a defined period, and additional compensation such as pain and suffering is not available.
Disputes can arise about how an injury is classified. If you disagree with an assessment, you may have options to challenge the decision and seek a different outcome.
Under the NSW CTP scheme, you may still be entitled to claim certain benefits even if you were at fault for the accident.
This can include access to medical treatment and limited income support for a period of time. However, fault may affect the extent of compensation available, particularly for longer term claims.
Understanding how fault impacts your entitlements is important, and obtaining advice early can help ensure you take the correct steps.
You are not required to have a lawyer to make a CTP claim. However, the process can become complex, particularly where insurers dispute liability, treatment or the extent of your injuries.
An experienced CTP claims lawyer in Sydney can assist in preparing your claim, managing communication with insurers and advising you on your rights throughout the process. Legal guidance can also be important if a decision is disputed or if there are issues requiring review.
Having the right advice can help ensure your claim is handled correctly and that your entitlements are protected.
