Who can claim?

Workers compensation is available to employees and some sub-contractors who have sustained an injury at work.

The lodgement of any workers compensation claim should be made sufficiently and promptly to protect the injured worker’s interest to entitlements.

It is important for any injured worker to seek legal advice from a qualified lawyer so that they fully understand their entitlements.

Entitlements for workers compensation claims:

There are three types of entitlements under workers compensation:

• • Weekly compensation payments for loss of wages/earnings during the incapacity for work
  • Payment of reasonable and necessary medical expenses
  • Lump sum compensation for permanent impairment injuries

What will it cost?

If your claim for any entitlement has merits, your lawyer can apply to the Workers Compensation Independent Review Office (WIRO) for the funding of your claim.

Should WIRO approve funding to your lawyer, you will not need to pay.

How will it affect my employer?

Workers compensation insurance is compulsory in NSW. Your employer pays it so that you are covered if you are injured. The effect of any such claim is generally minimal on your employer.
