A lump sum can look straightforward. Before making a decision, understand which entitlements the agreement would bring to an end.
The October update and statutory periods
SIRA’s expanded EOI process began on 1 October 2026. Regulation Part 9A sets three eligibility classes and their conditions; the reform excludes coal miners, dust disease claims and volunteer workers. Clauses 49G and 49J set periods of 18 months for an EOI and 30 months for an approval application. SIRA identifies the corresponding dates as 1 April 2028 and 1 April 2029.
Section 87F requires independent legal advice; approval by the President of the Personal Injury Commission under section 87H is needed for the agreement to take effect. Sections 87F(6) and 87I distinguish the liability being commuted from compensation that remains payable: a partial commutation does not automatically end every entitlement. Check the agreement’s actual scope.

Prepare a comparison, not just a headline number
Before a consultation, list your current payments, regular treatment, expected future treatment and any unresolved questions about your condition. Bring the proposed agreement and the insurer’s explanation. Ask your adviser to identify what is being settled and what assumptions underpin the amount.
Questions worth asking
- Which eligibility class is being relied on?
- What happens if my treatment needs change?
- What legal and financial advice do I need before deciding?
- What documents are missing from the proposal?
This is an introduction to SIRA’s update, not a recommendation to accept a settlement. A deadline should prompt an early review of your options, not a rushed decision.
