A one-time payment may seem simple, but before making a decision, you must understand which liabilities will be terminated under the agreement.
October Update and Statutory Deadline
SIRA will begin accepting Expressions of Interest (EOIs) for an expanded pathway on October 1, 2026. Part 9A of the regulations specifies three eligibility categories and their respective conditions; this reform does not apply to coal miners, dust sickness claims, or volunteers. Sections 49G and 49J stipulate that EOIs must be submitted within 18 months of the effective date, and approval must be requested within 30 months, respectively; the corresponding dates listed by SIRA are April 1, 2028, and April 1, 2029.
Section 87F requires independent legal advice; the agreement is subject to approval by the Chairman of the Personal Injury Commission under Section 87H to become effective. Sections 87F(6) and 87I distinguish between the offset liability and the remaining balance: partial offset does not automatically terminate all rights to compensation. Always verify the actual scope of the agreement.

Compare the actual impact, not just the amount.
Before the consultation, please list your existing expenses, regular treatments, anticipated future treatments, and any unresolved health issues. Bring the proposed agreement and a statement from the insurance company, and have your lawyer explain which liabilities will be settled and what assumptions are used to determine the amounts.
Questions worth raising
- Based on which qualification should the application be submitted?
- What would be the consequences if treatment needs changed in the future?
- What independent legal and financial advice is needed before making a decision?
- What documents are still missing from the plan?
This article outlines the rules and is not an endorsement of settlement. Deadlines should prompt you to review your options early, rather than making a hasty decision.
